Terms of Use and Privacy Policy for the I-SOMATIC Website

Iris Bar Lev welcomes you to the I-SOMATIC website, available at www.i-somatic.com (the “Website”).

The Website was established by Iris Bar Lev, a Certified Clinical Somatic Educator and the founder of the Israeli Center for Educational Somatic Movement (the “Center”). The Website provides a convenient platform for registering for online and in-person classes conducted by Iris (the “Classes”), purchasing pre-recorded online classes (the “Recorded Classes”), and purchasing a variety of related products, including books, accessories, and other items (the “Products”).

The Website also provides information about Educational Somatic Movement and the services offered by the Center (the “Services”), as well as articles, educational content, and videos related to Educational Somatic Movement (the “Content”).

1. General:
   • Your use of the Website is subject to the terms and conditions set forth in these Terms of Use and Privacy Policy (the “Terms”). Please read these Terms carefully, as your access to and use of the Website constitutes your agreement to be bound by them.
     The Website reserves the right to modify these Terms at any time, at its sole discretion and without prior notice. Any such changes shall become effective immediately upon their publication on the Website.
   • These Terms apply equally to all users. Any use of masculine or feminine language is intended solely for convenience and shall be interpreted as referring to all genders equally.

   • Before using the Website, all visitors and customers acknowledge, represent, and agree that:
     • The Services and Content available on the Website are provided solely for educational and training purposes. Any exercises, techniques, or activities undertaken based on the Website’s Content must be performed only after viewing the relevant lesson in its entirety and carefully following all instructions provided.
     • Any participation in the Classes and/or use of the Recorded Classes must be undertaken with due care and caution. The user assumes full responsibility for any injury, loss, or damage of any kind that may result from participating in the Classes or using the Recorded Classes.
     • Users shall have no claim against the Website, its owner, employees, representatives, or anyone acting on its behalf for any direct, indirect, incidental, consequential, or other damage, including bodily injury, property damage, financial loss, or any other loss arising from the use of the Website, the Content, the Classes, the Recorded Classes, or the Services. This limitation of liability shall apply even if the Website has provided recommendations, guidance, or information regarding any matter or service. Under no circumstances shall the Website replace the user’s personal responsibility or assume responsibility for the user’s decisions or actions. The user assumes all risks and full responsibility for any injury or damage to themselves, their property, or any third party resulting from the use of, or inability to use, the Website, its Services, Content, Classes, or Recorded Classes.
     • The Classes and Recorded Classes are not intended to replace individualized consultation, medical advice, medical diagnosis, or medical treatment. They should not be considered professional advice, diagnosis, or treatment provided by healthcare professionals, including physicians, physiotherapists, or other licensed practitioners.
     • The Content and Recorded Classes are provided on an “as is” basis. They are not tailored to the individual needs of any specific user. Users shall have no claim against the Website regarding the nature, quality, capabilities, limitations, or suitability of the Content for their personal needs. Users seeking a program specifically tailored to their individual circumstances should register for a private online or in-person session.
     • The Website is provided on an “AS IS” basis, and all use of the Website is entirely at the user’s own risk.
     • Minors may use the Website only under the supervision and with the approval of a legally competent adult who is at least 18 years of age.
     • Users agree that, while using the Website, they will comply with all applicable laws, regulations, and governmental requirements.

3. The Website does not warrant the accuracy or completeness of the descriptions of the Services provided on the Website and shall not be liable for any errors, inaccuracies, omissions, or any resulting loss or damage.
4. Use of the Website:
   • Browsing and accessing the Website does not require registration and is available to all users.
   • The Website reserves the right, at its sole discretion, to deny or restrict any user’s access to the Website. Without limiting the foregoing, the Website may suspend or block access in any of the following circumstances:
     • If false or misleading information was intentionally provided when submitting details through the Website.
     • If the Website is used to carry out, attempt to carry out, facilitate, assist, encourage, or promote any act that is unlawful under the laws of the State of Israel, or appears to be unlawful.
     • If these Terms have been violated.
     • If the Website is used for the purpose of competing with the Website or its activities.
     • If a user engages in any conduct that interferes with or prevents other users from accessing or using the Website in any manner.

5. Services Offered on the Website:
   • The Services and Content offered through the Website are presented on the relevant pages of the Website.
   • The Website is under no obligation to maintain any particular selection, scope, or availability of Services and/or Content.
   • The Website reserves the right, at any time and at its sole discretion, to modify, replace, remove, reduce, or expand the Services and Content offered on the Website without prior notice.
   • The manner in which the Services and Content are presented on the Website shall be determined solely at the Website’s discretion.
6. Registration for Classes and Purchase of Services or Products:
   • The Website offers a variety of registration options for online and in-person Classes, including one-time participation in group classes, private sessions, monthly subscriptions, and other enrollment options (the “Registration Plans”).
   • In addition, the Website offers pre-recorded online classes (the “Recorded Classes“) as well as a variety of Products, including books, accessories, and other related items.
   • The available Registration Plans, Recorded Classes, and Products offered for purchase are presented and described on the relevant pages of the Website.
   • The Website is under no obligation to maintain any particular selection or availability of Registration Plans, Recorded Classes, or Products.
   • The Website reserves the right, at any time and at its sole discretion, to modify, replace, discontinue, reduce, or expand any Registration Plan, Recorded Class, or Product offered on the Website without prior notice.
   • Participation in the online and in-person Classes requires prior registration. During the registration process, the customer will select the preferred date and time from the available schedule displayed on the registration page. Upon successful registration and payment, the customer will receive a confirmation email at the email address provided during registration. For online Classes, the email will include the access link for attending the scheduled session.
   • The price displayed on the Website for each Registration Plan, Recorded Class, or Product is the current applicable price. The Website reserves the right to update its prices from time to time without prior notice. Any such changes shall not affect purchases that have already been completed.
   • Payment for any Service and/or Product purchased through the Website shall be made using one of the payment methods available on the payment page.
   • In addition to these Terms, the terms and conditions of the applicable payment processor or payment method shall also apply. Notwithstanding the foregoing, the Website reserves the right, at its sole discretion, to offer alternative payment arrangements to customers.
   • The purchase of any Service and/or Product is subject to the Website’s approval of the transaction. If a transaction is not approved, the customer will be notified accordingly, and no charge will be made.
   • For subscription-based Registration Plans, the subscription will automatically renew unless canceled by the user.
7. Delivery of Products and Services:
   • The Classes will be conducted either through the Zoom platform or in person, depending on the type of Class. The Services will be provided at the date and time reserved by the customer, subject to the Website’s confirmation.
   • Recorded Classes will be made available to the customer after payment, either through a link to a dedicated page on the Website providing access to the Recorded Classes or through a download link, as applicable.
   • The provision of the Services is subject to the Website’s sole discretion. The Website shall not be liable for any delay in providing the Services, interruption of the Services, or failure to provide the Services resulting from force majeure, technical malfunctions, or circumstances beyond its reasonable control.
   • The Website will arrange delivery of Products purchased through the Website to the shipping address provided by the customer at the time of purchase, subject to the following terms:
     • Orders for Products will be processed and shipped within up to 14 business days via Israel Post. Shipping charges shall be as specified on the Website at the time of purchase. For the purposes of these Terms, “Business Days” means Sunday through Thursday, excluding official public holidays, holiday eves, and any day on which banks in Israel are closed.
     • The purchase price of a Product does not include shipping costs. Shipping fees are charged separately and may be updated from time to time as indicated on the Website.
     • Delivery of Products is available only within the State of Israel.
     • If a Product ordered through the Website is unavailable, the Website will notify the customer. If the customer cannot be reached within a reasonable time, the Website may ship the available Products without the unavailable item.
     • The Website shall not be liable for any delay in delivery or failure to deliver Products resulting from: (1) force majeure or other circumstances beyond the Website’s reasonable control; (2) delays or disruptions attributable to Israel Post; or (3) the closure or disruption of commercial activity affecting the Website, its suppliers, or its service providers for any reason.

8. Changes and Cancellation Policy:
   • Any request to change or cancel a booking, purchase, or registration must be submitted by email to the address provided at the end of these Terms. A request shall be deemed effective only after the customer receives written confirmation from the Website.
   • Cancellation of a group online Class, whether booked as a single session or as part of a monthly subscription, is not permitted and no refund will be issued. Instead, the customer will receive a credit that may be used to attend a future Class.
   • Cancellation of a private personalized session and eligibility for a refund shall be subject to the following conditions:
     
     • Cancellation made at least 24 hours before the scheduled session will entitle the customer to a full refund. Alternatively, the customer may reschedule the session, subject to availability.
     • Cancellations made less than 24 hours before the scheduled session are not eligible for a refund.
   • If a customer cancels a package or subscription for private personalized sessions, the customer will receive a refund for the unused portion of the package, less the full standard price of any private sessions already provided, based on the individual session rates published on the Website.
   • Cancellation of participation in a short course (consisting of four or six weekly sessions) and eligibility for a refund shall be subject to the following conditions:
     
     • Cancellation made at least 24 hours before the first scheduled online session will entitle the customer to a full refund of the course fee.
     • Cancellations made less than 24 hours before the first scheduled session are not eligible for a refund. In such cases, the customer will receive access to the course recordings.
   • Any request to reschedule a Class is subject to prior coordination with the Website and to the availability of alternative session dates.
   • Cancellation of the purchase of Recorded Classes is permitted only until access to the Recorded Classes has been provided. If a cancellation request is received before access is granted, the Website will issue a full refund using the original payment method. Once access to the Recorded Classes has been granted, no cancellation, exchange, or refund will be available.
   • Returns, exchanges, or cancellations of Product purchases are subject to the following conditions:
     
     • The request must be made within 14 days of the customer receiving the Product.
     • The Product must be returned to the Website at the customer’s expense, unopened and in its original packaging.
     • The Product must not have been used in any way.
     • The returned Product must be accompanied by the original purchase invoice or other proof of purchase.
     • All costs associated with returning the Product shall be borne by the customer.
     • A cancellation fee equal to 5% of the Product price or ₪100, whichever is lower, will apply.
     • If the return, exchange, or cancellation results from a defect in the Product, the Website shall be responsible for collecting or replacing the defective Product. Any Product claimed to be defective will be inspected by the Website. If, following inspection, the Product is found not to be defective, no refund will be issued, and the customer may request that the Product be returned upon payment of the applicable shipping charges.
   • The provisions of this Section 8 are subject to the applicable provisions of the Israeli Consumer Protection Regulations (Cancellation of a Transaction), 2010, and the Israeli Consumer Protection Law, 1981.
     
     
9. Limitation of Liability:

   • The Content available on the Website and the Classes are provided for general educational purposes only. They are not intended to replace individualized consultation, diagnosis, or treatment by a qualified professional and are not tailored to the specific circumstances of any individual. Nothing contained on the Website constitutes medical advice, medical diagnosis, medical treatment, or professional advice from a physician or any other licensed healthcare provider. Any action taken based on the information provided on the Website is undertaken solely at the user’s own risk.

   • Nothing contained on the Website shall be construed as a guarantee of any particular outcome or as a warranty regarding the effectiveness of the Services offered. The Website shall not be liable for any direct or indirect loss or damage arising from reliance on information published on the Website, information available through links to external websites, or any other internal or external source of information, or from the use of any Services offered through the Website.
   • The Content is provided on an “AS IS” basis and cannot be adapted to the individual needs of every user. Users shall have no claim against the Website regarding the nature, quality, capabilities, limitations, or suitability of the Content for their personal needs.
   • Any information or representations regarding services provided by the Website’s business partners, where such services are presented on the Website, are the sole responsibility of those business partners. Accordingly, the Website assumes no responsibility for such information and makes no representation or warranty as to its accuracy, completeness, or reliability.
   • The Website shall not be liable for any direct or indirect damage, loss, expense, inconvenience, or emotional distress suffered by users or any third party as a result of using or relying upon any Content, information, data, representations, images, videos, audio materials, advertisements, Products, Services, or any other material available on the Website. Any reliance on such materials is solely at the user’s own discretion and risk.
   • Under no circumstances shall the Website be liable for any loss or damage arising from a user’s contact or dealings with the Website’s business partners.
